Terms and Conditions
Please read our terms and conditions of use carefully before signing up for this membership. By signing our application, you signify that you agree to the terms that are listed below.
Heritage Heating & Cooling Service Membership
When you choose to open a service membership account with Heritage Heating & Cooling, you hereby agree to pay all charges to your account in accordance with the billing terms that are in effect at the time that the charge becomes payable. Your membership is a minimum 12-month agreement that will automatically renew, and your checking account, credit, or debit card will be charged each month unless you cancel your membership prior to the anniversary date. Heritage Heating & Cooling reserves the right to increase monthly fees only on the anniversary date. The 12-month payment plan starts over each anniversary date. Once it is renewed, if you choose to cancel, you will be obligated to either pay for the services you have received at full price or the full 12 months of the agreement.
If you choose to pay your membership on a monthly basis, you will then be debited monthly for the membership out of a debit, credit, or checking account. When you join, you are agreeing to pay for a full year of payments. However, if you choose to cancel prior to your full year, you then become responsible for the services that are rendered at full cost or the rest of the length of the full year. If you decide to cancel your membership after 6 months, and we performed one of both maintenance visits, you are to pay for the remainder of your 6-month agreement for the services that were performed.
If you want to cancel your membership you may do so by calling us or sending an email to email@example.com. When you request to end your membership, there is no refund on any unused portions of your current membership. Discounts are based on 12-month memberships, and in the event that discounts were given for services rendered, new equipment, or diagnostic fees, and you terminate your membership prior to the 12-month minimum, you then agree to reimburse the discount in full prior to your membership cancellation.
Your right to service is subject to any limits that are established by Heritage Heating & Cooling or by your bank or credit card issuer. If payments cannot be charged to your car or if the charge is returned for any reason, including chargeback, Heritage Heating & Cooling may terminate or suspend your membership, thereby terminating this agreement and all obligations of Heritage Heating & Cooling hereunder. Heritage Heating & Cooling also has the right to send a termination invoice during this time.
Checking and Credit Card Information
We at Heritage Heating & Cooling take issues of privacy seriously, this includes the security of your credit card and banking information. We will only be using your information for internal purposes and your information is not to be shared with any other organizations or sold for solicitation to any other businesses.
Limitation of Liability
Under no circumstances including but not fully limited to, negligence, shall we be liable for any incidental, direct, indirect, consequential, or special damages that result from the use of or inability to use any services that are provided under this agreement. Applicable law may not allow for the limitation or exclusion of liability or consequential or incidental damages, so the above exclusion or limitation may not apply to you. In no event shall our total liability to you for all losses, damages, and caused of action (where in contract in tort including but is not limited to negligence or otherwise) exceed the amount paid by you, if any, for your membership.
Heating & Cooling Memberships
Precision Service Schedule
We will contact you when it is time for your precision service to be scheduled. Our team will call you, send an email reminder or a letter reminder in the mail, or do all that we can until we reach you. We have programmed specific dates for our technicians to be in your area. This allows our team to maximize the day and ensure that there is a prompt response time for your scheduling needs. If you do not schedule your service by the end of that specific cooling or heating season, your visit will then expire.
Clients that use geothermal, mini-splits, boilers, or heat pumps will be charged a higher rate of $19.95 per month per system. The silver membership only is applied to clients that have a standard air conditioner or furnace.
